(1) A director shall: (j) Assess each staff person's interaction with children in care and classroom performance through an annual written performance evaluation; Findings: General: Based on review of documentation, two (2) staff members (DOH: 03/30/23 and 08/05/15) did not have an annual performance evaluation available for review at the time of survey.

922 KAR 2:090. Section 11. Staff Requirements. (1) Child-care center staff: (b) Shall provide, prior to employment and every two (2) years thereafter: 1. A statement from a health professional that the individual is free of active tuberculosis; or 2. A copy of negative tuberculin results. Findings: General: Based on review of documentation, the following was found: 1. One (1) staff member (DOH: 08/16/23) had a TB test on file that expired on 11/26/24 and was not renewed until 04/30/25. 2. One (1

(1) The premises shall be: (a) Suitable for the purpose intended; (b) Kept clean and in good repair; Findings: General: Based on observation, the following was found: Room 105 1. In the restroom, a pipe leading from the sink to the wall was taped with masking tape to secure it in place. 2. The handwashing sink was caulked to the wall, however, the caulk was peeling and beginning to fail, causing the sink to be an injury hazard.

922 KAR 2:120. Section 4. Premises Requirements. (9) Floors, walls, and ceilings shall be smooth, in good repair, and constructed to be easily cleaned. Findings: General: Based on observation, the restroom in Room 101 had areas of chipped paint around the sink and paper towel dispenser.

922 KAR 2:120. Section 13. Toys and Furnishings. (1) All toys and furniture contacted by a child shall be: (a) Kept clean and in good repair; and (b) Free of peeling, flaking, or chalking paint. Findings: General: Based on observation, the following was found: Room 101 1. The alphabet rug had several large, light-colored stains. Room 103 1. The circle time rug had several spots of fraying edges and missing edge-banding. Room 105 1. The alphabet rug had several small stains at various locations.
