    • 101161 Limitations on Capacity (A) A Licensee Shall Not Operate a Child Care Center Beyond the Conditions and Limitations Specified on the License, Including the Capacity…CCR 101161(a)

      Based on observation and interview, the licensee did not comply with the section cited above in that 15 children were present on the playground at the same time. There were only 5 children signed in for the day. All of the children were in the same age group. However, both the school district children and the licensed preschool children were using the playground at the same time, which poses/posed a potential health, safety or personal rights risk to persons in care.       Based on interview, observation, and record review, the licensee did not comply with the section cited above in that the licensee changed which rooms were being used for licensed child care, and did not inform the Department of this change, which poses/posed a potential health, safety or personal rights risk to persons in care.       Based on record review, the licensee did not comply with the section cited above in that 2 out of 2 staff, Staff 1 (S1) and Staff 2 (S2), did have proof of child abuse mandated reporter training in their files.
