Based on record review at 8:45 a.m., the center's daily attendance record for children failed to accurately reflect the children on the child care premises at any given time as 6 children were present and 5 children were signed in on the log. This was corrected prior to the Specialist exiting the center. Corrective Action: Effective 5/12/2026, S1 will review the attendance at 8 a.m. and 9 a.m. each morning for accuracy to ensure compliance with this regulation.

Based on interview at 9:45 a.m., although an approved Pediatric First Aid and CPR training certificate for S3 dated 2/22/2026 was presented to the Specialist, the early learning center staff failed to have current certification in Pediatric First Aid and CPR within 90 calendar days from the date of hire and prior to assuming sole responsibility for any children. The Specialist observed S3 (DOH: 1/27/2026) with sole responsibility of 4 children, 4-months-old to 11-months-old. S3 stated she has not completed the training. 2.: Based on observation at 8:45 a.m., S3 failed to ensure the manufacturer's restraint device was in use when a bouncer was occupied by C1. This was corrected prior to the Specialist exiting the classroom. Corrective Action: Effective 5/12/2026, S1 will review with all infant room staff that the manufacturer's restraint device must be in use when equipment is occupied by children to ensure compliance with this regulation.

a. Based on observation at 8:45 a.m., S2 failed to follow the Electronic Devices Policy as electronic devices were used by children under age 2. The Specialist observed C3, one-year-old, watching cartoons on the television in S2's classroom. This was corrected prior to the Specialist exiting the classroom. Corrective Action: Effective 4/9/2026, S1 will review the Electronic Device Policy with all staff to ensure compliance with this regulation.

Based on record review at 10:15 a.m., the center failed to have documentation of S3's CCCBC-based determination of eligibility for child care purposes from the department available on the center’s CCCBC roster at all times. Corrective Action: Effective 4/9/2026, S1 will have all new staff added to the CCCBC on their first day present to ensure compliance with this regulation.

1907.E.2. Based on observation at 8:40 a.m., the center's cribs failed to be free of soft or loose bedding (including blankets) while a child was in a crib. The Specialist observed C1, four-month-old, and C2, three-month-old, asleep in their cribs and covered with a blanket in S3's classroom. This issue was corrected prior to the Specialist exiting the center. Corrective Action: Effective 4/9/2026, S1 will review with all staff that infant cribs must be free of blankets if the child is in the crib to ensure compliance with this regulation.

Based on observation at 8:40 a.m., all of the infants failed to be on their backs for sleeping. The Specialist observed C2, three-month-old, asleep on her stomach in S3's classroom. C2 is unable to roll over. This was corrected prior to the Specialist exiting the center. Corrective Action: Effective 4/9/2026, S1 will review with all staff that infant cribs must be free of blankets if the child is in the crib, even if the child is awake, to ensure compliance with this regulation.

1909.G. Based on observation at 8:40 a.m., S3 failed to ensure a bib was not worn by a child while asleep. The Specialist observed C1, four-months-old, asleep in crib while wearing a bib. This was corrected prior to the Specialist exiting the classroom. Corrective Action: Effective 4/9/2026, S1 will review with all staff that bibs cannot be worn while an infant is sleeping to ensure compliance with this regulation.

Based on record review and interview, S1 failed to have documentation of tornado drills that were conducted at least once per month during the months of March, April, May, and June. The Specialist reviewed tornado drills for 2026 and verified no drill was completed in March 2026. Corrective Action: Effective 4/9/2026, S1 will set a monthly reminder to complete tornado drills in March, April, May, and June to ensure compliance with this regulation.

Per interviews with S1 and O1, notification of the incident was made to O1 after C1 was picked up from the center and after the center was closed. 1515.A.1. Based on record review at 10 a.m., S3 failed to have an information record completed with the correct date of birth for C1, 1-year-old. This was corrected prior to the Specialist exiting the center.

1707.A.1.2. Based on record review at 10:15 a.m., S1 failed to have a qualified director who is an on-site full time staff person at the center during the day time hours of operation (prior to 9:00 p.m.) and responsible for planning, managing, and controlling the center's daily activities, as well as responding to parental concerns and ensuring that minimum licensing requirements are met. The Specialist reviewed the daily attendance records and observed S1 was present a total of 36 hours from 12/4/2024 through 1/7/2025.

1713.E. Based on observation at 9:10 a.m., S4 failed to devote her time to supervision of the children and in participation with the children in their activities. The Specialist observed S4 on her cell phone while supervising 5 children, ages 1-year-old through 3-years-old. This was corrected prior to the Specialist exiting the classroom.

1811.A.B. Based on record review at 10 a.m., documentation of a CCCBC based determination of eligibility (CCCBC) failed to be conducted for 1 of 6 staff at least once during a five-year period. S3's date of hire is 9/14/2019. Her CCCBC based determination of eligibility expired 9/24/2024. She was present at the center working without a CCCBC based determination of eligibility on 9/24/2024 and 9/25/2024. S3 received a CCCBC based determination of eligibility on 9/26/2024.
