Based on observation, interview and record review, the licensee did not comply with the section cited above as a staff member, who has a pending criminal record clearance, was observed caring for children in a classroom with other staff. The staff member was fingerprinted but an error occurred. The facility believed the staff member had a clearance based on documentation they received.
