A family day care home may provide care for a maximum of: 4 children from birth to 12 months of age. 3 children from birth to 12 months of age, and other children, for a maximum total of six children. 6 preschool children if all are older than 12 months of age. 10 children if no more than 5 are preschool age and, of those 5, no more than 2 are under 12 months of age. There were [8] children observed in care and their ages were [Mixed age group containing one infant and five year olds. ]. 402.302(8), F.S., FDCH/LFCCH Handbook, Section 2.2.1 When arriving, the licensing specialist observed a ratio of 8:1 with five-year-olds and one infant. To come back into compliance, the FDCH will maintain proper ratios. The Family Day Care Home handbook states: A family day care home shall be allowed to provide care for one of the following groups of children, which shall include household children under 13 years of age: (a) A maximum of four children from birth to 12 months of age. (b) A maximum of three children from birth to 12 months of age, and other children, for a maximum total of six children. (c) A maximum of six preschool children if all are older than 12 months of age. (d) A maximum of 10 children if no more than 5 are preschool age and, of those 5, no more than 2 are under 12 months of age.

During the licensure year, the operator failed to conduct monthly fire drills utilizing the approved fire alarm system or smoke detector at various dates and times when children are in care. FDCH/LFCCH Handbook, Section 7.21, A The fire drill record was missing several fire drills. To bring back into compliance, the director conducted a fire drill on site and will do two fire drills for the month of March. The Family Day Care Home states: 7.21 Fire Drills A. During the homes licensure year, fire drills utilizing the smoke detector(s) must be conducted monthly at various dates and times when children are in care. B. When the homes smoke detectors(s) is/are activated or initiated, all adults and children must evacuate the home. C. The smoke detector(s) must be operable at all times. D. A current attendance record and parent/guardian contact information must accompany child care personnel out of the home during a drill or actual evacuation, and be used to account for all children. The operator must maintain a written record of the fire drills showing the date, number of children and child care personnel in attendance, evacuation route used, and time taken for all individuals to evacuate the premises. Each fire drill record must be maintained for a minimum of 12 months from the date of the fire drill. The fire drills conducted must include, at a minimum: 1. One fire drill during the established napping/sleeping times, 2. One fire drill using an alternate evacuation route, and 3. One fire drill in the presence and at the request of the licensing authority in coordination with the operator or designee.

The enrollment form used by the operator was incomplete and/or did not include all required information as required on CF-FSP Form 5219. FDCH/LFCCH Handbook, Section 8.3, A, C and F The licensing specialist reviewed all 7 children's files. Children BM and BL were missing their dates of enrollment on their 5219 Child Care Application form. The director filled in the missing elements bringing this provider back into compliance. The Family Day Care Home Handbook states: 8.3 Enrollment Information A. The operator shall obtain enrollment information from the childs custodial parent or legal guardian prior to accepting the child into care. This information shall be documented on CF-FSP Form 5219, Child Care Application for Enrollment, which is incorporated by reference in 65C-22.001(7)(f), F.A.C., or an equivalent that contains all the information required by the Departments form.
