1723.A.&B.: : Based on record review at 12:31 p.m., S1 failed to have documentation that 3 of 13 staff on the premises and accessible to children have current certification in infant, child, and adult CPR through training approved by the Department. S3, S10, and S12 certification expired on 02/28/2026. A class has been scheduled for June 18, 2026. Corrective Action: Effective 06/10/2026, S1 stated she will set a reminder 30 days prior to expiration date of required training to ensure compliance with this regulation.

A CCCBC-based determination of eligibility for child care purposes from the department was not obtained for independent contractor, prior to the person performing services at the center. The Specialist observed O1 signed into the center at 8:35 a.m., for class observations. O1 was sitting in the front of the center and walked into a classroom with 9, 2-3 year-olds, not accompanied by a staff member. 1811.A&B.: Based on Record Review/Interview at 12:15 p.m., S1 failed to obtain documentation of a CCCBC-based determination of eligibility (CCCBC) for staff members, prior to being present in the childcare facility. Documentation of a CCCBC-based determination of eligibility was not conducted for S5 (First day present: 7-28-2025), prior to being present in the childcare facility. S5 has been present and working in the center since 7/28/2025. Based on observations, on 12/10/2024, at 11:00 a.m.., S7 failed to maintain close proximity or accompany children while they were walking to the restroom. The Specialists observed C11 (three-year-old child), out of S7's sight. S7 did not provide adequate supervision for C11 while the child walked alone down the hallway to the restroom.

1103.B.D. Based on observations/record review/interviews, at 11:30am, S2 failed to notify the Department and Child Welfare within 24 hours, and the parent immediately of the following critical incident: On 10/07/2024, at 11:30pm, S10 yelled at C1 while grabbing him by the ankles, pulling him from underneath the slide. S10 picked C1 up underneath his arms, moving into an undisclosed area, for time-out. In a separate incident on the same day at 8:52 am, S10 yelled at C2 and C3 to line up, picking C3 up by both arms placing her in line.

1509.A.8.C. Based on interviews and record review, at 11:30 a.m., although the center has a Behavior Management policy, S10 (DOH 6/09/2023) used a prohibited method of discipline on 9/26/2024. While reviewing video footage for 9/26/2024 , the Specialists observed S10 pull C1, four-year-old, by his ankles, pulling him from under a slide, picking him up underneath his arms, moving into an undisclosed area, for time-out. In a separate incident on the same day at 8:52 a.m. , 10 yelled at C2 and C3 to line up, picking C3 up by both arms placing her in line.

Based on observation at 11:30am., S10 failed to use proper techniques for lifting a child, by not lifting C3(two-years-old) under her arms. While reviewing video footage of 9/26/2024, at 8:52am., the Specialists observed S10 lift C3, two-year-old, by her upper arms from the backside.
