Based on interviews and record review, although the center implemented a Behavior Management Policy prohibiting physical punishment, S9 used physical punishment on C1, 4-years-old, on 04/30/2026, at approximately 9:06 a.m. S1 observed video footage of S9 use her left hand to pull C1 by his shirt, shake him back and forth aggressively, then shove him backwards. 1103.A.5&C.2.: Based on record review and interviews on 2/5/2026, at 11:30 a.m., S1 failed to notify Child Welfare of the following critical incident: On 1/21/2026, at 6:17 p.m., S1 became aware of allegations that C1, 4-months-old, sustained a bruise under the left eye while in the center's care. This could not be corrected prior to the Specialist departure. Corrective Action: Effective 2/18/2026, S1 stated she will re-train the staff on critical incidents and required notifications and she will report to Child Welfare to ensure compliance with this regulation.

Based on observations, record review and interviews on 2/5/2026, at 11:30 a.m., S1, S2 and S5 failed to ensure the indoor and outdoor areas were free of hazards. ¨ On 1/21/2026, at 9:52 a.m., S5 reportedly caused warm milk to splash onto C1’s, 4-months-old face. The incident occurred while S5 was checking the temperature of C1’s bottle. According to S1, S5 had increased the temperature setting on the bottle warmer. 1711.A.B.D. Based on observations on 02/13/2025 at 10:00 a.m., child to staff ratio failed to be met at all times. Specialists observed S3 supervising 13, 2 year-old children; S3 could only supervise 10 children. There needed to be an additional staff in the class. This was corrected when S7 arrived at 11:45 a.m.
