Based on record review and interviews at 12:00 p.m., although the center has a behavioral management policy implemented, S2 (DOH 8/14/2015) used a prohibited method of discipline as C1, age 4-years-old, was subjected to physical punishment. On 4/16/2026 at approximately 11:17 a.m., C1, was forcibly grabbed by the collar of his shirt, was yelled at, and also aggressively seated on the floor by S2. Corrective Action: Effective 5/4/2026, S1 stated she will retrain staff on the Behavior Management policy to ensure compliance with this regulation.

Based on record review/interviews, at 9:59 a.m., although the center had a written behavior management policy implemented, S2 (DOH 02/28/2025) used a prohibited method of discipline as C1, age three-years-old, was subject to physical/corporal punishment. Based on record review and interviews at 11:27 a.m., on 03/26/2026, at approximately 12:54 p.m., S2 used a prohibited method of time out as C2, 4-years-old and C3’s, 3-years-old, length of time out exceeded 1 minute per year of age of child. C2 was placed in timeout for 22 minutes and C3 was placed in timeout for 19 minutes. Corrective Action: Effective 04/06/2026, S1 stated she will provide additional training classes to all staff and remind them of the center’s policy that they do not conduct timeout to ensure compliance with this regulation.

Based on record review/interviews on 10:22 a.m., S2 failed to lift children using proper lifting techniques as on 03/25/2026, S2 was observed, on the center's video footage, lifting C1, age 4-years-old, by one arm (left arm) and carrying him from one side of the classroom to the other side of the classroom. Corrective Action: Effective 04/06/26, S1 stated she will conducting monthly trainings with all staff about proper lifting techniques to ensure compliance with the regulation.

Based on record review and interviews at 1:00 p.m., S1 failed to notify the parent immediately and LDOE within 24 hours of the following critical incident: On 2/10/2026, the parent of C1, age 4-years-old, reported to S1, that C1 and C2, age 5- years- old were given food by S2 out of the trash can during lunchtime on 2/09/2026. On 2/11/2026, at approximately 9:30 a.m., S1 reviewed camera footage and observed S2 pulled a saran wrapped plate out the trashcan and split the food between C1 and C2.
